The court granted provisional anticipatory bail to the petitioner subject to conditions and verification of his antecedent.
Summary
The petitioner, Pappu Kumar Yadav, was implicated in a case under Sections 30(a) and 41 of the Bihar Excise Act for the alleged recovery of 10 litres of liquor from a motorcycle he owned. He claimed he had a clean antecedent, was not in possession of the liquor at the time of arrest, and was unaware that his friend misused the vehicle. The State opposed his request for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and a deposit of Rs. 2,500 with the Advocates’ Association, pending verification of his criminal antecedent. The order was made under Section 482(2) of the BNSS, with a condition that if any antecedent is discovered, the bail will not be confirmed.
Issues considered
- Whether the petitioner is entitled to anticipatory bail in a case under the Bihar Excise Act.
- Whether the petitioner’s ownership of the vehicle and alleged lack of knowledge of the offence justify bail.

recovered from his conscious possession and he came to be
implicated based on the fact that he is owner of the seized

his own vehicle for committing an occurrence and thus would
