                    learned APP for the State, Mr. Chandra Bhushan Prasad.

                                2. The learned counsel for the petitioner, after some

                    arguments and after perusing the reports submitted by the

                    learned Exclusive Special Excise Judge-1, East Champaran,

                    Motihari contained in Letter No. 362 dated 08.04.206, seeks

                    permission to withdraw the modification application.

                               3. Permission is accorded.

                                 4. Accordingly, the modification application is

                    dismissed as withdrawn.
