Holding

The Court granted provisional anticipatory bail to the petitioners subject to conditions and verification of their criminal antecedents.

Summary

The petitioners, Shatranj Manjhi and Surendra Manjhi, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 12 litres of liquor from a public place. They argued they have no conscious possession of the liquor, the alleged informant is not named in the FIR, and they possess a clean criminal record. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and directed verification of the petitioners' antecedents. It further stipulated that if any antecedent is discovered, the bail would not be confirmed for that petitioner, but if the antecedents remain clean, the bail would be confirmed. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act where the alleged recovery was from a public place and no conscious possession is established.
  • Whether the absence of a named informant in the FIR and the petitioners' clean antecedent justify granting anticipatory bail.

Subjects

  • anticipatory bail
  • Bihar Excise Act
  • Section 30(a)
  • Section 482(2)
  • clean antecedent
  • FIR
  • secret informant
  • bail bond

                                4. Learned counsel for the petitioners submits that

petitioners were not apprehended from the spot as such nothing

was recovered from their conscious possession and even alleged

be implicated at the instance of local person, but then the name

of the person who disclosed the name of the petitioners is not

disclosed in the FIR which casts an aspersion on the case of the

prosecution and petitioners have not been implicated based on

secret information and admittedly are persons with clean

          antecedent.

                       5. Learned A.P.P. for the State opposes the prayer for
