Patna High Court

Ranjeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail on furnishing a bond of Rs.5,000 with two sureties.

Summary

The petitioner, Ranjeet Kumar, was arrested in connection with the alleged recovery of 131.250 litres of liquor from a vehicle, charged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018. He claimed to have a clean antecedent and argued that he was falsely implicated by an informant, not being the owner of the seized vehicle and merely passing through a checkpoint. The State opposed his regular bail. After hearing both sides, the court found the petitioner's submissions credible and noted the lack of strong evidence of his involvement. Consequently, the court ordered his release on bail upon furnishing a bond of Rs.5,000 with two sureties. The bail order was directed to be complied with before the trial court handling the excise case.
