Patna High Court

Suganti Devi @ Subhati Devi @ Subhanti DeviversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court denied regular bail to the petitioner.

Summary

The petitioner, Suganti Devi, was arrested in connection with a case alleging that she and co‑accused strangled the informant’s daughter. She contended that she was falsely implicated because she opposed her son’s relationship with the deceased, who allegedly committed suicide. The petitioner applied for regular bail under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, claiming innocence and highlighting her prolonged custody since 15‑December‑2025. The State opposed the bail, emphasizing the seriousness of the charges. The Court, after considering the nature and gravity of the alleged offences, rejected the bail application and ordered the trial court to expedite the trial within one year. The order reflects the Court’s view that the seriousness of the alleged crime outweighs the petitioner’s bail request.

                                       ORAL ORDER

2 01-05-2026 Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. Petitioner seeks regular bail in connection with

Basantpur P. S. Case No. 33 of 2025 registered for the offences

punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya

                   Sanhita.

                                3. As per F.I.R., informant alleged that this petitioner

along with other F.I.R. named accused persons killed the

                   daughter of informant by strangulation.

                                4. Learned counsel for the petitioner submits that

petitioner is innocent and has committed no offence. Petitioner

has falsely been implicated in this case merely because she is

mother of co-accused Sonu Kumar, with whom the deceased

had love affair and petitioner used to oppose the relationship. As

a matter of fact, deceased committed suicide. Petitioner is lady

and is in custody since 15.12.2025.

                                     5. Learned A.P.P. for the State vehemently opposed

                        the bail application.

                                     6. Considering the nature of accusation and gravity of

the offence, prayer for bail of the petitioner is rejected.

                                     7. However, since petitioner is in custody since

15.12.2025, Trial Court is directed to expedite and conclude the

trial, preferably, within a period of one year from the date of

receipt/production of copy of this order.
