Holding
The Court granted bail to the petitioner subject to specified conditions.
Summary
Navrangi Sah was arrested on 31‑12‑2025 in connection with a FIR alleging assault on the brother of an informant, with charges under Sections 191(1), 190, 109, 352, 351(2) and 118(1) of the B.N.S., 2023. The petitioner claimed a clean antecedent, asserted that he was falsely implicated and that the FIR contained only a generic allegation against him while the specific assault was attributed to another accused. The informant and the State opposed bail, contending that the petitioner was a participant in the crime. The Court examined the nature of the allegations, the petitioner’s custody since 31‑12‑2025, and the lack of a specific overt act attributed to him. Considering the circumstances, the Court ordered the release of the petitioner on bail with a bond of Rs. 10,000 and two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence or witnesses, and verification of criminal antecedents. The bail order was directed to be implemented by the Judicial Magistrate of Bikramganj, Rohtas.
Issues considered
- Whether the petitioner is entitled to bail despite being named in the FIR and charged with multiple offences under the B.N.S., 2023
- Whether the lack of a specific allegation of assault against the petitioner warrants bail
