The Court ordered provisional anticipatory bail with bond and sureties, subject to verification of the petitioner’s criminal antecedents.
Summary
Kavita Devi, a widow residing in Patna, applied for anticipatory bail fearing arrest in a case registered under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 20 litres of liquor from her house. She contended that the liquor was located in a joint‑family property, that she had no conscious possession, and that the concept of deemed possession had been abolished by the 2018 amendment. The State opposed the bail, arguing the seriousness of the offences. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bond of Rs.15,000 and two sureties, directing verification of her criminal antecedents within six weeks. The order further stipulated that if more than three prior cases are found, the bail would not be confirmed; otherwise it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail can be granted under Section 438 Cr.P.C. for offences under the Bihar Prohibition and Excise (Amendment) Act, 2022 when the accused claims lack of conscious possession and joint‑family ownership of the alleged liquor.
- Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
