Holding

The Court granted provisional anticipatory bail to the petitioner, subject to bail bond conditions and verification of his criminal antecedents.

Summary

The petitioner, Mithun Kumar, sought anticipatory bail after learning that he might be arrested in a case under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018, alleging recovery of 162 litres of liquor from a vehicle he did not own. He argued that the police had implicated him based on secret information without proper investigation and that no liquor was found in his possession. The State opposed the bail, contending that the allegations warranted detention. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and subject to verification of the petitioner’s criminal antecedents. It further directed that if the petitioner is found to have more than two prior cases, the bail would not be confirmed, whereas confirmation would follow if only two antecedent cases are verified.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
  • Whether the conditions imposed under Section 482(2) of the B.N.S.S. are applicable.
