Patna High Court

Vijay Vardhan Singh @ Angad Singh @ Vijoy Bardhan SinghversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The bail application is rejected.

Summary

The petitioner, Vijay Vardhan Singh, sought bail in a case involving alleged murder under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act. He has a history of twenty pending cases, with fourteen acquittals and bail in six others, and has been in custody since February 2024. The State argued that three persons were killed and the petitioner’s name emerged from confessional statements of co‑accused. The petitioner contended that all prosecution witnesses had been examined and the trial had stalled since January 2026. The Court, after hearing both sides, declined to grant bail, directing the trial court to complete the trial within four months and to avoid unnecessary adjournments. Consequently, the bail application was rejected.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences (murder and illegal possession of arms) and his extensive criminal record.
  • Whether the stage of the trial and the fact that prosecution witnesses have been examined justify release on bail.
