BAIL GRANTED

Holding

Bail was granted to the petitioner on condition of a Rs 10,000 bond with two sureties.

Summary

The petitioner, Sushant Kumar, was arrested in connection with a robbery and assault alleged to have occurred on 11 December 2025, where he and a co‑accused allegedly snatched Rs 6,570 from an informant and assaulted him. The informant identified the petitioner, and the case was registered under Sections 115(2), 126(2), 109, 304(2), 351(2), 352 and 3(5) of the Bhartiya Nyaya Sanhita, 2023. The petitioner, a young student with no prior criminal record, applied for bail, arguing that the injuries were simple, no weapon was used, and continued detention would harm his education. The State opposed bail, citing the seriousness of the offences. After considering the facts, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs 10,000 with two sureties, satisfying the conditions of the ACJM‑I, Sitamarhi.

Issues considered

  • Whether bail should be granted to the petitioner despite the charges of robbery, assault and other offences under the Bhartiya Nyaya Sanhita, 2023.
  • Whether the petitioner’s lack of prior criminal record and the nature of the alleged injuries justify bail.
