The court granted bail to the petitioner.
Summary
The petitioner, Sonu Kumar Singh, was arrested in connection with a case involving the recovery of stolen motorcycles in Raxaul, East Champaran. The prosecution alleged that the petitioner was part of a stolen‑motorcycle racket based on statements of co‑accused persons, although no weapon or motorcycle was found in his possession. The petitioner contended that he was falsely implicated, was not named in the FIR, and that the only incriminating evidence against him stemmed from a co‑accused's confessional statement. He also highlighted his three prior antecedents and his custody since 11‑12‑2025, while assuring cooperation with the investigation. The State opposed bail, arguing the seriousness of the offences under the Bhartiya Nyaya Sanhita, 2023. Considering the circumstances, the court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties.
Issues considered
- Whether bail should be granted to the petitioner under the Bhartiya Nyaya Sanhita, 2023, given the nature of the offences and the petitioner’s antecedents
- Whether the petitioner’s alleged involvement, based solely on co‑accused statements, warrants continued detention
Legislation cited
- Bhartiya Nyaya Sanhita, 2023 — s. 111(2)(b), 317(2), 317(4), 317(5), 3(5)
