Patna High Court

Anjani Pal @ Anjani Kumar @ Anjani Kumar PalversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The bail application was rejected.

Summary

Anjani Pal was charged under several serious provisions of the Indian Penal Code and Section 27 of the Arms Act. He applied for regular bail before the Patna High Court, having previously been denied bail twice in 2024 and 2025, with a liberty to reapply if the trial exceeded seven months. The petitioner’s counsel argued that the petitioner has a clean antecedent and that all prosecution witnesses have been examined, with the case now at the argument stage. The State opposed bail, emphasizing the gravity of the offences and the petitioner’s repeated attempts to secure release. The Court, after hearing both sides, declined to grant bail, directing the trial court to conclude the trial within three months and to avoid unnecessary adjournments. Consequently, the bail application was rejected.

Issues considered

  • Whether bail should be granted to the petitioner given the seriousness of the offences and the stage of the trial
  • Whether the petitioner’s clean antecedent and the completion of witness examination justify bail
  • Whether the trial can be concluded within a reasonable time to justify bail

                                       ORAL ORDER

2 11-05-2026 1. Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. The petitioner seeks bail in a case registered for the

                   offences punishable under Sections 452, 324, 307, 504, 506 and

120B of the Indian Penal Code read with Section 27 of the Arms

                   Act.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and this is the third

attempt of the petitioner to seek regular bail.

                                4. The learned APP, at this stage, submits that

petitioner had earlier moved this Court seeking regular bail by

filing Criminal Miscellaneous No. 26283 of 2024 and the same

came to be rejected by an order dated 21.06.2024 after

considering the case on merits. It is further submitted that

thereafter petitioner again moved this Court seeking regular bail

by filing Criminal Miscellaneous No. 32913 of 2025 and the

same also came to be rejected by an order dated 20.06.2025, but

then a liberty was granted to the petitioner to renew his prayer

for bail if the trial is not concluded within a period of seven

          months.

                       5. On query of the Court from the learned counsel

appearing on behalf of the petitioner with regard to the stage of

the trial, the learned counsel appearing on behalf of the

petitioner fairly submits that all prosecution witnesses have been

examined and the case for the last four months is at the stage of

          argument.

                       6. After hearing the learned counsel for the parties, the

Court is not inclined to release the petitioner on bail.

                       7. However, the learned Trial Court is directed to

ensure that the trial is concluded within a period of three months

from the date of receipt/production of a copy of this order, if

what has been submitted by the learned counsel appearing on

behalf of the petitioner is true.

                       8. It is also directed that no unnecessary/undue

adjournments be given in the trial.

                                  9. Accordingly, the instant bail application stands

                      rejected.

                                 10. Let a copy of this order be communicated to the

                      learned Trial Court.
