Patna High Court

Binod KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a cash bond, sureties and specified conditions.

Summary

Binod Kumar was arrested on 21 September 2025 in connection with FIR dated 9 July 2025 alleging offences under Sections 126(2), 118(1), 109 and 3(5) of the B.N.S., 2023. The prosecution alleged that the accused, including the petitioner, assaulted an informant with a knife, causing injuries. The petitioner contended that he was falsely implicated, that the FIR was fabricated, and that only the co‑accused were the principal offenders, noting that the co‑accused had already been granted anticipatory bail. The State opposed bail on the ground of the petitioner’s prior criminal antecedent and his presence in the FIR. The Court, after considering the submissions, granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding cooperation, non‑tampering with evidence, and verification of his criminal antecedent.

Issues considered

  • Whether the petitioner is entitled to bail despite the alleged offences and his prior criminal antecedent.

present case. The allegation as alleged in the F.I.R. is false and

fabricated and the petitioner has not committed any offence as

alleged in the F.I.R. Although the petitioner is named in the

F.I.R. but from perusal of the F.I.R. it appears that there is no

Kumar and the petitioner is at best the member of the mob. He

                      5. The learned Additional Public Prosecutor has

vehemently opposed the prayer for bail of the petitioner on the
