Randhir Singh @ Randhir KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Bail was denied to the petitioner.

Summary

The petitioner, Randhir Singh, applied for bail in a case registered as PS Case No. 158 of 2025, involving offences under Sections 109, 309(6) and 311 of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act. The incident arose from an attempted loot during which a victim assaulted a criminal; the petitioner was later identified in the T.I. parade as one of the perpetrators. He has been in custody since 12 September 2025 and has nine prior criminal antecedents. The Court considered the gravity of the offences, the petitioner’s identification, and his extensive criminal record. Concluding that these factors outweighed the presumption of innocence, the Court refused bail, dismissing the application while noting that the order is limited to the bail question and does not prejudice the trial’s merits.

Issues considered

  • Whether bail should be granted to the petitioner given the seriousness of the offences, his identification in the T.I. parade, and his multiple prior criminal antecedents.
