Sintu Kumar@Sintu Kumar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Sintu Kumar Yadav, was named in an FIR alleging that he, along with others, assaulted an informant with hockey sticks and an iron rod, damaged property and looted cash and a gold chain. He contended that the allegations were vague, that no specific overt act could be linked to him, and that he had a clean antecedent. The State opposed his anticipatory bail application. The court examined the nature of the accusations, the seriousness of the alleged injuries, and the petitioner’s clean record, and decided to grant anticipatory bail. The bail was conditioned on surrender within eight weeks, furnishing a bail‑bond of Rs.10,000 with two sureties, and compliance with Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order was pronounced by Justice Prabhat Kumar Singh.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the inherent powers of the court
