Ranjan KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The bail application was dismissed, denying the petitioner relief.

Summary

The petitioner, Ranjan Kumar, applied for bail in a case (Sugauli P.S. Case No. 522/2025) involving offences under Sections 111, 317(4), 317(5) read with 3(5) of the B.N.S. Act, relating to the disposal of stolen two-wheelers. The prosecution alleged that a large number of two-wheelers were recovered from the accused, including the petitioner, who is alleged to be a member of a gang dealing in such stolen vehicles. The petitioner claimed innocence, stating he has three prior criminal antecedents but nothing was recovered from his possession. The court considered the seriousness of the offences, especially the charge under Section 111 which carries a life sentence, and the petitioner’s alleged gang involvement. Consequently, the bail application was dismissed. The decision reflects the court’s view that the gravity of the charges outweighs the petitioner’s claim of innocence.

Issues considered

  • Whether bail should be granted to the petitioner in a case involving offences under Sections 111, 317(4), 317(5) and 3(5) of the B.N.S. Act
  • Whether the petitioner’s alleged involvement in a gang dealing in stolen two-wheelers justifies denial of bail
