Patna High Court

Kallu GopeversusThe State of Bihar

Decided
Disposal
WITHDRAWN

Holding

An anticipatory bail application may be withdrawn, and the petitioner may surrender and seek regular bail without prejudice.

Summary

Petitioner Kallu Gope filed an anticipatory bail application under criminal procedure. He later sought to withdraw that application and surrender to the trial court to obtain regular bail. The High Court allowed the withdrawal, directing that the trial court consider his regular bail application on its merits without prejudice arising from the withdrawn anticipatory bail. Consequently, the anticipatory bail petition was dismissed as withdrawn, and the petitioner was given liberty to surrender and seek regular bail. The order ensures that the withdrawal does not adversely affect his right to regular bail.

  • Whether withdrawal of anticipatory bail prejudices the petitioner’s right to obtain regular bail upon surrender
