The Court provisionally granted anticipatory bail to the petitioner, subject to bond, sureties, and verification of his criminal antecedent.
Summary
The petitioner, Nitish Kumar, sought anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, for the alleged recovery of 34.56 litres of liquor from his motorcycle. He argued that he had no prior criminal record, the liquor was not found in his conscious possession, and he was unaware that another individual, Mukesh Kumar, misused his vehicle. The State opposed the bail. The Court granted provisional anticipatory bail, requiring a bail bond of Rs.500 with two sureties, and conditioned the order on verification of the petitioner’s antecedent within six weeks. If any prior case is found, the bail may be revoked; otherwise, it will be confirmed. The petitioner also agreed to deposit Rs.1,500 with the Patna High Court Lawyers’ Association.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438(2) of the Cr.P.C. in the context of alleged violation of Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether the petitioner’s ownership of the vehicle used in the alleged offence suffices to justify denial of anticipatory bail.
