Patna High Court

Rajendra Singh @ Rajendra YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court held that there was no reason to interfere with the earlier order denying bail, and the petitioners may renew their bail application after one month if the trial is not concluded.

Summary

The petitioners, Rajendra Singh and co‑accused, applied for bail in a criminal case (Bagengola P.S. Case No. 109 of 2024) involving offences under Sections 191(1), 191(2), 190, 329(3), 115(2), 118, 117(2) and 103(1) of the B.N.S., 2023. Their earlier bail application had been rejected by this Court on 06‑08‑2025. The State argued that the defence arguments were concluded and the trial was expected to finish within a month. The Court examined the circumstances and found no justification to overturn the earlier order denying bail. Consequently, the bail petition was dismissed, but the Court allowed the petitioners to file a fresh bail application after one month if the trial remains pending.

Issues considered

  • Whether bail should be granted to the accused pending trial in the offences under the B.N.S., 2023
  • Whether the earlier order denying bail can be interfered with on the ground of trial delay
