Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner with specified bond and attendance conditions.

Summary

The petitioner, Munna Kumar, was arrested on 11 December 2025 in connection with a case registered under Raxaul Police Station for alleged dealing in a stolen motorcycle. He faced charges under Sections 317(2), 317(4), 317(5), 111(2)(b) and 3(5) of the Bharatiya Nyaya Sanhita. The petitioner pleaded innocence and sought regular bail, while the State opposed the relief. The Court examined the nature of the offences, the fact that the petitioner had been in custody for several months, and the absence of any indication of flight risk. Considering these circumstances, the Court ordered his release on bail upon furnishing a bond of Rs. 10,000 with two sureties of equal amount and imposed a condition of weekly police‑station attendance. The order was limited to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether bail should be granted to the petitioner charged under Sections 317(2), 317(4), 317(5), 111(2)(b) and 3(5) of the Bharatiya Nyaya Sanhita.
