Patna High Court

Sonu Nat @ Sonu KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied as the petitioner’s prior criminal record and the victim statements under Section 183 of the BNS justified the denial.

Summary

The petitioner, Sonu Nat, sought anticipatory bail fearing arrest in a case involving alleged trafficking of minor girls. The FIR alleged offences under the BNS, Immoral Traffic (Prevention) Act, POCSO Act, Juvenile Justice Act and Bounded Labour System Act, based on a raid that rescued minors. The petitioner argued that his wife heads a dance orchestra and that no immorality is involved. The State countered that several girls gave statements under Section 183 of the BNS supporting the prosecution’s version. The court noted the petitioner’s three prior criminal convictions and found no sufficient ground to grant anticipatory bail, thereby rejecting the petition.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the serious offences alleged under multiple statutes.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of anticipatory bail.
  • Whether the statements of the minor girls under Section 183 of the BNS substantiate the prosecution’s case.
