Anup KumarversusThe State of Bihar

Holding

The Court held that, given the petitioner’s young age, clean antecedent, and lack of personal possession of the alleged weapons, regular bail should be granted.

Summary

The petitioner, Anup Kumar, was arrested in connection with a firing incident alleged to have occurred on 15-12-2025 and charged under Sections 25(1‑B)a, 26, 27 and 35 of the Arms Act. The prosecution’s case was based on informant information and CCTV footage, but no direct incriminating material was found on the petitioner and the firearms were recovered from a co‑accused’s house. The petitioner, a 23‑year‑old with no prior criminal record, pleaded innocence and sought regular bail, undertaking to cooperate with the trial. The State opposed bail, arguing the seriousness of the offences. Considering the petitioner’s young age, clean antecedent, lack of personal possession of the weapons, and the circumstances of custody, the Court granted regular bail on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under the Arms Act.
  • Whether the nature of the allegations, the petitioner’s age, and clean antecedent justify granting bail.
  • Whether the absence of incriminating material in the petitioner’s possession warrants bail.
