Holding

Provisional anticipatory bail is granted subject to bond, sureties and verification of the petitioner’s criminal antecedents.

Summary

The petitioner, Jitendra Sahni, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 and Section 317(5) of the Bihar Narcotic Substances Act, 2023. He has six prior criminal cases, five relating to excise, and is alleged to have been involved in the recovery of 56.4 litres of liquor from a motorcycle, though he was not arrested on the spot and no liquor was found in his possession. The prosecution’s case relied on a confessional statement made by another individual, Ranjan, while in police custody, which the petitioner argued lacks evidentiary value. The court, after hearing both sides, granted provisional anticipatory bail conditioned on a bail bond of Rs.30,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedents. If more than six prior cases are found, the bail will not be confirmed; if exactly six, the bail will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner given the nature of the alleged offence and his prior criminal antecedents.
  • Whether the confessional statement of a co-accused made in police custody can form a basis for arrest in the absence of other evidence.
