The court held that anticipatory bail may be granted subject to conditions, given the petitioner’s clean antecedent and the circumstances of the case.

Summary

The petitioner, Shekh Ahmad, sought anticipatory bail after being implicated in a case (Birpur P.S. Case No.189 of 2025) under multiple sections of the Bharatiya Nagarik Suraksha Sanhita, 2023, alleging assault, theft, and indecent behavior during a land dispute. The prosecution alleged that the petitioner, along with co‑accused, assaulted an informant and injured Jabir Khan with an iron rod, and also stole a gold locket. The petitioner contended that he was falsely implicated, the injuries were simple, and the incident stemmed from a land dispute, emphasizing his clean antecedent. The State opposed the bail. Considering the nature of the allegations, the petitioner’s clean record, and the possibility of surrender within six weeks, the court granted anticipatory bail on condition of furnishing a bail bond of Rs.10,000 with two sureties, subject to Section 482(2) of the B.N.S., 2023. The order was pronounced by Justice Sunil Dutta Mishra.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 in view of the serious charges framed against him.
  • Whether the petitioner’s clean antecedent and the nature of the alleged offences justify the grant of bail.
