Patna High Court

Masid @ Md. MasidversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Anticipatory bail was denied because the seriousness of the murder and related charges rendered the case unfit for such relief.

Summary

The petitioners, a group of ten villagers, applied for anticipatory bail fearing arrest in a criminal case (PS 225 of 2025) concerning the murder of Md Azam and related offences. The charge sheet lists offences under several sections of the Bharatiya Nyaya Sanhita, including murder, attempt to murder, and offences against public tranquillity, as well as Section 27 of the Arms Act. The factual allegation is that the petitioners were part of a mob that killed the deceased while attempting to capture land. The court examined whether the seriousness of the allegations precluded the grant of anticipatory bail. It held that the nature of the case, involving homicide and multiple serious offences, made it unsuitable for anticipatory bail. Consequently, the petition for anticipatory bail was dismissed.
