The court held that the petitioner’s clean antecedent and the circumstances of the case warranted the grant of bail, subject to strict conditions.
Summary
Bhim Singh was arrested on 18-12-2025 in connection with an assault on Arjun Singh, the father of an informant, under several sections of the B.N.S., 2023. The petitioner claimed a clean antecedent, false implication, and that the incident arose from a land dispute without intent to kill. The State opposed bail, emphasizing the specific assault allegation. The court examined the facts, noting the direct allegation but also the petitioner’s clean record and the circumstances, and decided to grant bail. Bail was ordered on a Rs.10,000 bond with two sureties and several conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents.
Issues considered
- Whether the petitioner is entitled to bail despite the specific assault allegations under the B.N.S., 2023.
- Whether the petitioner’s clean antecedent and the nature of the dispute justify granting bail.
