Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a Rs.10,000 bond with two sureties.

Summary

The petitioner, Jitendra Rai, was charged under Section 414 of the IPC and Section 30(a) of the Bihar Excise Act for allegedly being involved in the recovery of 697.32 litres of liquor from a Bolero vehicle. He has seven prior cases, five under the Excise Act, and claims he was not arrested at the spot, that the seized vehicle was not his, and that he was implicated solely on the basis of a chowkidar's information without proper investigation. The petitioner has been in custody since 12‑12‑2025 and seeks bail. The State opposed the bail application. The Court, after considering the petitioner's submissions, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, directing compliance with the trial court's conditions.

Issues considered

  • Whether bail should be granted to the accused under Section 414 IPC and Section 30(a) Bihar Excise Act despite antecedent cases
  • Whether the circumstances of arrest and lack of seizure from the accused's possession justify bail
