Akhilesh KumarversusThe State of Bihar

Holding

Provisional anticipatory bail is granted subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Akhilesh Kumar, the owner of a truck, was implicated in a case (PS Bidupur Case No. 360 of 2021) for alleged possession of 69.12 litres of liquor in a truck and 82.965 litres in a Nano car, offences punishable under Section 30(a) of the Bihar Excise Act read with Section 414 of the IPC. He contended that the liquor was not found in his conscious possession, that he was unaware of his driver’s alleged misuse of the vehicle, and that ownership alone should not render him liable. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 5,000 with two sureties and directed verification of the petitioner’s criminal antecedent. It further stipulated that if more than one antecedent is found, the bail would not be confirmed; if only one antecedent is found, the bail would be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the alleged excise offences.
  • Whether ownership of the vehicle used for alleged liquor transport suffices to implicate the petitioner without proof of conscious possession.
