Holding
The court granted anticipatory bail to the petitioner, holding that the conditions for bail under Section 438 CrPC were satisfied.
Summary
Durgesh Kumar Deep was arrested in a complaint alleging cruelty and dowry harassment under Section 498A IPC and Sections 3 and 4 of the Dowry Prohibition Act, based on allegations by his mother-in-law, Indu Devi, that his wife was subjected to torture and ousted from her matrimonial home. The petitioner contended that he is innocent, that the allegations are false, and that the complainant habitually files cases to harass him, noting that multiple cases, including four under 498A, have been filed against him. He also highlighted that his wife receives a total maintenance of Rs. 35,000 per month as ordered by family courts. The court considered the petition for anticipatory bail, examining the applicability of Section 438 of the CrPC and Section 482 of the B.N.S.S., 2023, and the merits of the allegations. After hearing counsel, the court allowed the anticipatory bail, imposing a bail bond of Rs. 10,000 with two sureties and conditions under the relevant statutes.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the Code of Criminal Procedure in the pending complaint under Section 498A IPC and Dowry Prohibition Act.
- Whether the allegations of cruelty and dowry harassment are sufficient to deny bail, considering the petitioner’s claim of false implication and existing maintenance orders.
