Patna High Court

Munilal SahversusThe State of Bihar

Decided

DISPOSED

Holding

The Court conditionally granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Munilal Sah, was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 270 litres of liquor from two motorcycles. He contended that he was not in possession of the liquor, that the vehicles were owned by him but were misused by a friend who fled the scene, and that he had no knowledge of the offence. The petitioner sought anticipatory bail, arguing that a prudent person would not use his own vehicle to commit the offence and that he was unaware of the misuse. The State opposed the bail. The High Court granted provisional anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and directed verification of the petitioner’s criminal antecedent, stipulating that if more than two prior cases are found, the bail would not be confirmed. The order is conditional under Section 482(2) of the Bihar Non‑Compromise Settlement Act.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the Bihar Non‑Compromise Settlement Act in view of the alleged offence under the Bihar Excise Act.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.

Subjects

  • anticipatory bail
  • excise law
  • liquor seizure
  • vehicle ownership
  • criminal antecedent
  • Section 30(a) Bihar Excise Act
  • Section 482 CrPC
