Patna High Court

Jairam BindversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The application for bail is allowed and the petitioner is released on bail upon furnishing the prescribed bond and sureties.

Summary

The petitioner, Jairam Bind, applied for bail in a case registered under Sections 103(1) and 3(5) of the B.N.S., 2023, alleging that he was falsely implicated in a dowry‑related murder. The prosecution alleged that the petitioner killed the deceased for dowry, but the petitioner claimed innocence and a clean antecedent. The State opposed the bail, while the petitioner’s counsel argued that the allegations were false and the petitioner had been in custody since 10‑11‑2025. The Court, after considering the facts, the false nature of the allegation, and the period of custody, allowed the bail application. The petitioner was ordered to be released on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, subject to the satisfaction of the District & Additional Sessions Judge, Munger.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the alleged offence under Sections 103(1) and 3(5) of the B.N.S., 2023.
  • Whether the allegation against the petitioner is false and thus warrants bail.
  • Whether the period of custody and the petitioner’s clean antecedent justify bail.
