Bhola SinghversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court denied regular bail to the petitioner.

Summary

Bhola Singh applied for regular bail in a case registered under Sections 103, 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act, alleging that he shot the son of an informant, resulting in death. The petitioner claimed innocence and highlighted that he had been in custody since 15 September 2025. The State opposed the bail, emphasizing the seriousness of the allegations. The Patna High Court, after hearing both sides, rejected the bail application, finding the allegations sufficiently grave to deny regular bail. However, the Court directed the trial court to expedite the trial and conclude it within one year of receiving the order.

Issues considered

  • Whether regular bail should be granted to the petitioner given the nature of the offences alleged under the Bharatiya Nyaya Sanhita and the Arms Act
  • Whether the custody period already served warrants consideration for bail
