The Court conditionally granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedent.
Summary
Vinesh Kumar applied for anticipatory bail after a case was registered under Sections 30(a) and 41(i) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that 31.875 litres of liquor were recovered from two motorcycles, one of which he owned. He contended that he was not arrested at the spot, that the liquor was not in his conscious possession, and that he was unaware his friend would misuse the vehicle. The State opposed the bail, arguing the seriousness of the offences. The Court, considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedent. If the verification shows more than two prior cases, the bail will not be confirmed; if only two, the bail will be confirmed forthwith.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the Criminal Procedure Code in view of the alleged offences under the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether the petitioner’s alleged ownership of the vehicle and prior criminal antecedent affect the grant of anticipatory bail.
