The court granted anticipatory bail to the petitioner subject to a bail bond and conditions under Sections 2(1)(d) and 482(2) of the Bhartiya Nyaya Sanhita, 2023.
Summary
Mangesh Bind was named in an FIR (Shakurabad P.S. Case No. 243 of 2025) alleging assault, robbery and other offences under the Bhartiya Nyaya Sanhita, 2023. The petitioner, a student at an ITI institute, claimed he was innocent, that the incident was a mutual scuffle between neighbours, and sought anticipatory bail. The State opposed the bail but submitted a certificate confirming his student status. The court examined the applicability of Sections 2(1)(d) and 482(2) of the BNS, 2023 and the circumstances indicating no likelihood of fleeing or tampering with evidence. Accordingly, the court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs 30,000 and comply with conditions for a period of four weeks.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under the Bhartiya Nyaya Sanhita, 2023.
- Whether the facts disclose a likelihood of the petitioner fleeing, tampering with evidence, or committing further offences.
