Holding
The court held that bail may be granted in the present case despite the petitioner’s antecedents, provided the stipulated conditions are fulfilled.
Summary
Santosh Yadav was arrested in connection with Excise P.S. Case No. 753 of 2025 for alleged possession of 8.4 litres of country‑made liquor recovered from a motorcycle. The petitioner contended that he was merely a passer‑by, not the owner of the vehicle, and that no incriminating material was found in his conscious possession. He also highlighted the lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and pointed to his four prior criminal antecedents. The State opposed the bail application, arguing the seriousness of the offences under Sections 30(a) and 32 of the Bihar Prohibition and Excise Act. After considering the custody period, the absence of direct evidence against the petitioner, and the circumstances of his alleged involvement, the Court decided to grant bail. Bail was conditioned on a bond of Rs.15,000 with two sureties and specific compliance requirements.
Issues considered
- Whether bail should be granted to the accused in a case under Sections 30(a) and 32 of the Bihar Prohibition and Excise Act despite prior criminal antecedents.
- Whether the non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the grant of bail.
