Bharat YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners subject to a bond of Rs 10,000 each and two sureties.

Summary

The petitioners, Bharat Yadav, Santosh Kumar and Ram Kailas Yadav, were arrested on 3 December 2025 in connection with a land‑dispute‑related assault and charged under several sections of the B.N.S., 2023. They applied for bail before the Patna High Court, arguing that there is a counter‑case and that they have also suffered injuries. The State opposed the bail on the ground of the seriousness of the offences. The Court, after hearing the senior counsel for the petitioners and noting the length of their custody, decided to grant bail. Each petitioner was ordered to furnish a bail bond of Rs 10,000 with two sureties of the same amount, subject to the satisfaction of the Judicial Magistrate, 1st Class, Sherghati. The Court expressly clarified that it made no finding on the merits of the underlying criminal case.
