Patna High Court

Hira Mandal @ Hira Kumar @ HiraversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to bond and surety conditions.

Summary

The petitioner, Hira Mandal, was arrested in connection with a dowry‑death case (Sursand P.S. Case No. 21 of 2025) under Sections 80(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleges that the deceased was killed by her husband and in‑laws for non‑payment of dowry, but the petitioner claims he is the husband of the deceased, made no dowry demand, and has no criminal antecedents. The charge‑sheet is general and does not specifically implicate the petitioner, while a co‑accused has already been granted bail. The State opposed bail, but the court, considering the lack of specific allegations, the petitioner’s clean record and the length of custody, decided to grant bail. Bail was ordered on the condition of a Rs.15,000 bond with two sureties, one of whom must be a close family member, and the petitioner must appear at every trial date.

Issues considered

  • Whether bail should be granted to the petitioner under Sections 80(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 in a dowry‑death case.
  • Whether the general nature of the charge‑sheet and lack of specific allegation against the petitioner justify denial of bail.
  • Whether the petitioner’s custody period, clean antecedent and the bail granted to a co‑accused warrant bail in this case.
