The Court granted provisional anticipatory bail to the petitioner, subject to verification of his criminal antecedent.

Summary

The petitioner, Raju Kumar, sought anticipatory bail fearing arrest in a case registered under Sections 317(5) and 3(5) of the Bihar Narcotic Substances Act read with Section 30(a) of the Bihar Excise Act, alleging recovery of large quantities of liquor from a house and two motorcycles. He argued that he had no direct possession of the liquor and was implicated only because he owned one of the seized vehicles, asserting a clean antecedent. The State opposed the bail, contending the allegations warranted detention. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and a condition that the trial court verify the petitioner’s criminal antecedent within six weeks. The order stipulated that if any antecedent is discovered, the bail would be cancelled; otherwise, it would be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances of alleged liquor possession and ownership of the vehicle.
  • Whether ownership of a vehicle used in the alleged offence makes the owner liable for anticipatory bail.
  • Whether a clean criminal antecedent is a prerequisite for confirming anticipatory bail.
