The Court granted provisional anticipatory bail to the petitioner, subject to bond, sureties and verification of antecedents.

Summary

The petitioner, Binod Chaudhary, sought anticipatory bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 18 litres of liquor from his joint family house. He contended that he was not arrested at the scene, no liquor was found in his conscious possession, and the amendment of 2018 had abolished the concepts of deemed possession and presumed offender. The State opposed the bail, arguing the seriousness of the offence. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.25,000 and two sureties, invoking its inherent powers under Section 482(2) of the CrPC. The order also directed the trial court to verify the petitioner’s criminal antecedents and conditionally confirm the bail based on whether the antecedent cases exceed five.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Effect of the 2018 amendment removing deemed possession on the prosecution’s case.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
