Patna High Court

Bachcha SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Bachcha Singh, applied for bail in a criminal case (Sangrampur P.S. Case No. 439 of 2025) where his son, Manoj Singh, is alleged to have committed offences under Sections 126(2), 115(2), 118(1), 109, 303(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita. The petitioner had been in custody since 10 January 2026 and the informant opposed the bail. The court examined whether the seriousness of the charges and the involvement of the petitioner’s son warranted denial of bail. Considering that the petitioner himself was not the principal accused and that the main assailant was his son, the court found no substantive ground to refuse bail. Consequently, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs. 10,000 with two sureties of the same amount. The order was limited to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences alleged against his son.
