Decided

BAIL GRANTED

Holding

The court granted regular bail to the petitioner, subject to verification of the compromise and the victim’s support.

Summary

Harjeet Kumar was arrested in connection with a kidnapping case involving a minor girl, charged under Sections 96, 352, 351(2), 3(5) of the B.N.S. and Sections 4 and 8 of the POCSO Act. The petitioner claimed innocence, asserted that the parties had settled the dispute, and filed a compromise petition in the lower court, also highlighting his clean antecedent. The prosecution opposed the bail application, arguing the seriousness of the offences. The High Court, after considering the facts and the petitioner's undertaking to cooperate, allowed regular bail on a bond of Rs. 10,000 with two sureties, subject to verification of the compromise by the Sessions Judge and the victim’s support. If the victim does not support the compromise, the bail bond will be cancelled.

Issues considered

  • Whether bail can be granted in a kidnapping case involving a minor under the POCSO Act despite the seriousness of the offences
  • Whether a compromise petition and the petitioner's clean antecedent justify the grant of regular bail
