Holding

The Court granted provisional anticipatory bail to the petitioner, subject to verification of his criminal antecedents and compliance with the stipulated conditions.

Summary

The petitioner, Chandan Kumar, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly recovering 5.5 litres of liquor from a location adjacent to his shop. He argued that the liquor was not in his possession, the alleged recovery site did not belong to him, and the complaint was prompted by a hostile watchman rather than any police investigation. The State opposed his request for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.10,000 with two sureties and that the trial court verify his criminal antecedents. The order stipulated that if more than two prior cases are found, the bail would not be confirmed; if exactly two are found, the bail would be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the conditions imposed under Section 482(2) of the Criminal Procedure Code are appropriate for granting provisional anticipatory bail.

2 08-04-2026 1. Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

registered for the offence punishable under Section 30(a) of

                   Bihar Prohibition and Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of two cases and allegation is of

recovery of 5.5 litres of liquor from a place behind the shop of

the petitioner. It is next submitted that petitioner was not

chowkidar with whom he is on an inimical term. It is also

submitted that if chowkidar was aware of the involvement of the

petitioner in the occurrence then why he did not inform the

police prior to institution of the instant FIR which casts an

aspersion on the case of the prosecution. It is next submitted that

of late police has started implicating accused having criminal

antecedent in cases relating to excise for obvious reason without

          holding a proper investigation.

                       4. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

counsel for the petitioner, the petitioner above-named, in the

from today, be released on provisional anticipatory bail on

furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with

conditions as laid down under Section 482(2) of the B.N.S.S.

                       6. It is made clear that the learned trial court thereafter

shall verify the criminal antecedents of the petitioner and in the
