The court granted provisional anticipatory bail to the petitioner, subject to bond, sureties and verification of antecedents under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Chandan Sahani, sought anticipatory bail after the police registered a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 alleging recovery of large quantities of liquor from land adjacent to his poultry farm. He contended that he had a clean antecedent, that the liquor was not found in his possession, and that the complaint was motivated by an inimical relationship with the chowkidar who made the accusation. The State opposed the bail, arguing the seriousness of the offence. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a modest bail bond and two sureties, subject to verification of the petitioner’s antecedents under Section 482(2) of the B.N.S.S. The order stipulated that if any antecedent is discovered, the bail would not be confirmed, but if the petitioner is found clean, the bail would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s clean antecedent and lack of possession of the alleged liquor justify anticipatory bail.
  • Whether the High Court may impose conditions under Section 482(2) of the B.N.S.S. while granting provisional anticipatory bail.

                   A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

registered for the offence punishable under Section 30(a) of

Bihar Prohibition and Excise (Amendment) Act, 2022.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

recovery of 900.87 litres of liquor from a mustard field behind

the poultry farm of the petitioner and 85.425 litres of liquor

from a place near a government washroom. It is next submitted

that petitioner was not arrested from the spot as such nothing

was recovered from his conscious possession and even alleged

implicated at the instance of chowkidar with whom he is on an

inimical term. It is also submitted that if chowkidar was aware

of the involvement of the petitioner in the occurrence then why

he did not inform the police prior to institution of the instant

FIR which casts an aspersion on the case of the prosecution. It is

also submitted that chowkidar in order to save the real culprit

falsely implicated the petitioner when petitioner admittedly is a

          person with clean antecedent.

                       4. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                       5. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the
