Patna High Court

Khayali Yadav @ Khiyali YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, directing his release on bail subject to statutory conditions.

Summary

The petitioner, Khayali Yadav, was named in an FIR (Noorsarai PS Case No.375 of 2020) for murder, kidnapping and conspiracy under Sections 302, 201 and 120‑B read with 34 of the IPC. The FIR alleged that co‑accused called the informant's husband, who later went missing and was found dead, but the petitioner's counsel argued that no specific allegation linked him to the act and that his inclusion was merely due to a long‑standing land dispute. The petitioner also faces three other criminal cases with the same informant but is on bail in those matters. The prosecution contended that the petitioner was actively involved, yet admitted that the FIR only raised suspicion against him. Considering the lack of concrete evidence and the precedent of anticipatory bail granted to other co‑accused, the Court ordered his release on bail subject to conditions under Section 438(2) CrPC and Section 482(2) BNSS 2023.

Issues considered

  • What is the appropriate relief when an accused is implicated in an FIR solely on the basis of suspicion?
  • Whether anticipatory bail can be granted under Section 438 CrPC and Section 482 BNSS in the present case.
