BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner.

Summary

The petitioner, Ankit Kumar, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 63.9 litres of liquor recovered from a vehicle. He claimed innocence, stating he was merely a passerby and not the owner of the vehicle, and that no incriminating material was found in his possession. The State opposed bail, while the petitioner highlighted two prior criminal antecedents and the lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The Court, after considering the facts, the period of custody since 14‑12‑2025, and the petitioner’s assertions, decided to grant bail. Bail was set at Rs. 15,000 with two sureties, subject to conditions including family surety and regular appearance in court.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the circumstances of the case.
  • Whether the non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, precludes the grant of bail.
