Patna High Court

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Md. Pintu, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2022 (Amendment) after 213.3 litres of illicit liquor were seized from a motorcycle. He has been in judicial custody since 9 February 2026 and claims he was falsely implicated, asserting a clean antecedent. The prosecution’s case is based solely on the statement of a co‑accused, and the petitioner was not arrested at the scene. The petitioner’s counsel sought regular bail, while the State opposed it. Considering the lack of direct evidence, the petitioner’s clean record, and the circumstances, the court ordered his release on bail upon furnishing a bond of Rs. 10,000 with two sureties.
