Patna High Court

Pawan Yadav @ Pawan KumarversusThe State of Bihar

Decided

DISPOSED

Holding

The Court granted provisional anticipatory bail subject to bond, sureties and verification of antecedents, with confirmation contingent on the number of prior cases.

Summary

The petitioner, Pawan Yadav, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, where 57.03 litres of liquor were allegedly recovered from public premises and not from his possession. He argued that the investigation was mechanically driven, relying on a chowkidar’s statement without proper inquiry, and highlighted his three prior excise cases. The State opposed the bail. The High Court, applying Section 482(2) of the B.N.S.S., granted provisional anticipatory bail conditioned on a Rs.15,000 bond with two sureties and ordered verification of his criminal antecedents. The order stipulated that if more than three prior cases are found, the bail would not be confirmed; if exactly three, it would be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in an offence under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the lack of recovery from the petitioner’s possession and the manner of investigation justify denial of bail.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.

and even alleged recovery is from a place which does not

belong to the petitioner and is accessible to public at large and

police prior to institution of the instant FIR which casts an

aspersion on the case of the prosecution. It is also submitted that
