Patna High Court

Deepak KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner.

Summary

The petitioner, Deepak Kumar, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing 200 litres of country-made liquor recovered from a motorcycle. He claimed innocence, stating he was merely a passerby and not the owner of the vehicle, and that no incriminating material was found in his possession. The petitioner had been in custody since 28-11-2025, had no prior criminal record, and argued that Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, was not complied with. The State opposed bail. Considering the lack of evidence against him, his clean record, and the procedural lapse, the Court decided to grant bail, ordering a bond of Rs. 15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the facts of the case
  • Whether the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, warrants bail
