Patna High Court

Shanti DeviversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court declined to grant pre‑arrest bail and disposed the application.

Summary

Shanti Devi applied for pre‑arrest bail in a case registered under several sections of the Bihar Narcotic Substances Act and the Dowry Prohibition Act. The High Court examined the seriousness of the allegations recorded in the FIR. The Court was not persuaded to grant pre‑arrest bail, noting the nature of the offences. However, the Court directed the petitioner to surrender before the District Court and apply for regular bail, citing that the petitioner’s son, a co‑accused, had been granted regular bail by a coordinate bench. The application for pre‑arrest bail was therefore disposed without any order of bail.
