Patna High Court

Rahul KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the bail application, directing the petitioner’s release on bail with specified conditions.

Summary

The petitioner, a revenue officer, was arrested on a charge of taking a Rs.5,000 bribe under Section 7(a) of the Prevention of Corruption Act. He applied for regular bail, claiming false implication, lack of prior criminal record, and willingness to cooperate with the trial. The vigilance prosecution opposed bail, asserting that the petitioner had taken illegal gratification. The court examined the facts, noting the absence of any allegation of tampering, the filing of a charge sheet, and the petitioner's clean antecedents. Considering these circumstances, the court ordered that the petitioner be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions of cooperation and appearance. The application for bail was therefore allowed.

Issues considered

  • Whether bail can be granted to a person charged under Section 7(a) of the Prevention of Corruption Act
  • Whether the petitioner's lack of criminal antecedents and willingness to cooperate justify the grant of regular bail
